What is a barrister?

As a barrister Owen is an experienced and independent dispute resolution specialist.

While traditionally barristers have required an “instructing solicitor”, in many instances barristers can now take instructions directly from clients. If an instructing solicitor is required, Owen can assist you to find one.

Information for clients

Set out below is the information required by the Rules of Conduct and Client Care for Lawyers of the New Zealand Law Society (“NZLS”).

Fees

The basis on which fees will be charged and when payment of fees is required is set out in Owen’s Standard Terms of Engagement and / or letter of engagement.   

Professional Indemnity Insurance

Owen maintains professional indemnity insurance that meets or exceeds the minimum standards specified by the NZLS.

Client Care and Service 

As your lawyer Owen must:

  • Act competently, in a timely way, and in accordance with instructions received and arrangements made.

  • Protect and promote your interests and act for you free from compromising influences or loyalties.

  • Discuss with you your objectives and how they should best be achieved.

  • Provide you with information about the work to be done, who will do it and the way services will be provided.

  • Charge a fee that is fair and reasonable and let you know how and when you will be billed.

  • Give you clear information and advice.

  • Protect your privacy and ensure appropriate confidentiality.

  • Treat you fairly, respectfully and without discrimination.

  • Keep you informed about the work being done and advise you when it is completed.

  • Let you know how to make a complaint and deal with any complaint promptly and fairly.

The obligations lawyers owe to clients are described in the Rules of Conduct and Care for Lawyers.  Those obligations are subject to other overriding duties, including duties to the Court. More information is available at www.lawsociety.org.nz or on 0800 261 801.

Limitations on liability

Limitations on the extent of Owen’s obligations or liability to you are set out in his Terms of Engagement and / or letter of engagement.  Generally, his liability is limited to the maximum cover provided by his professional indemnity insurance.

Complaints

If you have a complaint, please discuss it with Owen first.  If you prefer, you may refer your complaint to an independent barrister to be agreed between you.  The NZLS operates The Lawyers Complaints Service and you are able to make a complaint to that service.  Information and advice about that service is available on 0800 261 801.
